HVU has recently received an update with regard to
Opus and their illegally removing trees:

I was asked to respond to your e-mail.
The Judge has signed a deferred disposition order in this matter. The defendant
will pay all court costs, post a $13,500.00 cash bond and plant 10 6"-8" minimum
caliper trees according to the tree plan. The cash bond will be reduced to
$4,500.00 when the city certifies to the court that the trees have been planted
timely. The defendant must not commit any city ordinance violations.
The trees should be replaced within the next 6 months.
We anticipate it will happen sometime this fall since that is the best time for
planting.

HVU receives many requests for information with regard
to all of the trees that Opus illegally removed from the FM407/FM2499 property
during excavation as well as questions with regard to allowed construction
times. To follow is a letter from city manager, Michael Leavitt with an
update:

Councilmember Mario Ramirez has asked me to respond to your e-mail dated April
14, 2006 concerning the trees that were removed by the Opus Corporation on the
northeast corner of FM 407/FM 2499. Currently, this matter is in the Highland
Village Municipal Court. There has been a delay because of the Upper Trinity's
relocation of a water line. The prosecutor is working on a plan for mitigation
and replacement of the trees as required by the City's ordinance.
You also mentioned that the work crews were on the site into the evening hours.
The normal work hours are 7:00 .m. – 7:00 p.m. Monday – Friday, 9:00 a.m. – 5:00
p.m. on Saturday and no work is allowed on Sunday. Our Code Enforcement Officer
has been in touch with the Project Superintendent and to make sure that these
times are adhered to. However, exceptions are granted if requested and there are
circumstances when they will be given to allow the crews to complete their jobs.
